Welcome to Althea Wellness Company ("Althea Wellness," "we," "us," or "our"), accessible at www.altheawellnesscompany.com (the "Site"). These Terms and Conditions ("Terms") govern your access to and use of the Site, and your purchase or use of any health coaching, breathwork, or related services (the "Services") offered by Althea Wellness.

By accessing the Site, booking a consultation, or purchasing any Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.

1. About Our Services

Althea Wellness provides nervous-system-led health coaching, breathwork sessions, and related lifestyle and wellness guidance. Our services are educational and supportive in nature and are designed to help clients explore nervous system regulation, stress physiology, and lifestyle habits that may relate to digestive and overall wellbeing.

2. Not Medical Advice

Althea Wellness and its practitioners are not physicians, psychologists, psychiatrists, dietitians, or licensed healthcare providers, unless expressly stated otherwise. Nothing provided through the Site or Services — including consultations, coaching sessions, breathwork sessions, written materials, or any communication — constitutes medical advice, diagnosis, or treatment.

  • Our Services are not a substitute for professional medical, psychological, or psychiatric care.

  • You should always consult a licensed physician or other qualified healthcare provider before making changes to your diet, lifestyle, supplement regimen, or healthcare routine, and before starting any coaching or breathwork practice, particularly if you have a pre-existing physical or mental health condition, are pregnant, or are taking medication.

  • Never disregard, delay, or discontinue medical treatment because of information or guidance received through Althea Wellness.

  • If you are experiencing a medical or mental health emergency, call 911 (or your local emergency number) or go to the nearest emergency room immediately.

3. Eligibility

You must be at least 18 years old to book or purchase Services. By using the Site or Services, you represent that you meet this requirement and that any information you provide to us is accurate and complete.

4. Bookings, Consultations, and Sessions

  • Consultations and sessions are booked through our online scheduling system. You are responsible for providing accurate contact and health history information at the time of booking.

  • We reserve the right to reschedule, decline, or discontinue services at our discretion, including where we determine that coaching or breathwork is not appropriate for your circumstances or that a referral to a licensed medical or mental health provider is more suitable.

  • Breathwork sessions can involve intense physical and emotional sensations. You participate voluntarily and are responsible for communicating any relevant physical or mental health conditions before your session, and for stopping or modifying practice at any time you feel it is unsafe or unwise to continue.

5. Payment and Refunds

Fees for Services will be communicated to you prior to booking or purchase. Payment terms, cancellation windows, and refund eligibility are set out in our Refund Policy, which forms part of these Terms. By booking a session or program, you agree to that policy.

6. Client Responsibilities

You agree to:

  • Provide accurate, current information about your health history and circumstances when requested.

  • Use good judgment regarding your own physical and emotional limits during coaching and breathwork sessions.

  • Seek appropriate medical or emergency care when needed, rather than relying on Althea Wellness for urgent or emergency health needs.

  • Use the Site and Services lawfully and not misuse, disrupt, or attempt unauthorized access to the Site or its booking systems.

7. Confidentiality

We respect the privacy of information you share with us in connection with coaching and breathwork sessions. Please see our Privacy Policy for details on how we collect, use, and protect your personal information. Note that, unlike licensed healthcare providers, our services are not covered by HIPAA or formal therapist-client privilege unless expressly stated.

8. Intellectual Property

All content on the Site — including but not limited to the "Inner Rewiring Method™," text, graphics, logos, images, and other materials — is the property of Althea Wellness or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from this content without our prior written permission.

9. Testimonials

Testimonials shared on the Site reflect individual client experiences. Results vary from person to person, and no testimonial is a guarantee or prediction of the outcome you will experience.

10. Assumption of Risk and Limitation of Liability

To the fullest extent permitted by law:

  • You acknowledge that coaching and breathwork carry inherent risks, including but not limited to physical discomfort, emotional release, dizziness, or changes in mood or perception, and you voluntarily assume these risks.

  • Althea Wellness, its owner, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of health, income, or opportunity, arising out of or related to your use of the Site or Services.

  • Our total liability for any claim arising out of or related to the Services shall not exceed the amount you paid to Althea Wellness for the specific Service giving rise to the claim.

  • Nothing in these Terms limits liability where such limitation is not permitted by law (for example, liability for gross negligence or willful misconduct, where applicable).

11. Indemnification

You agree to indemnify and hold harmless Althea Wellness, its owner, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.

12. Third-Party Links and Tools

The Site may use third-party booking, payment, or scheduling tools (such as LeadConnector). We are not responsible for the content, policies, or practices of third-party websites or services linked from or used in connection with our Site.

13. Changes to Services and Terms

We may update these Terms, our Services, or our pricing at any time. Changes will be posted on this page with a revised effective date. Your continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.

We reserve the right to suspend or terminate your access to the Site or Services at any time, for any reason, including violation of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles, and any disputes shall be subject to the exclusive jurisdiction of the courts located in North Carolina.

Terms & Conditions for the 90 Day Calm Gut Challenge

By enrolling in 90 Day Calm Gut Challenge ("Program"), you agree to the following Terms and Conditions ("Agreement"). Please read them carefully before enrolling.

​

1. PARTICIPANT CONDUCT
​

We are committed to providing all participants with a positive experience. Thus, Althea Wellness Company may, at its sole discretion, limit, suspend, or terminate your participation in any of its programs, live, recorded, social-based, or digital without refund or forgiveness of remaining payments if:

  • You become disruptive or difficult to work with;

  • You fail to follow the program guidelines; or,

  • You impair the participation of our instructors or participants in our program(s).

2. PRIVACY AND CONFIDENTIALITY

We respect your privacy and insist that you respect the privacy of fellow Program participants. You agree:

  • Not to infringe any Program participants' or the Company's copyright, trademark, patent, trade secret, or other intellectual property rights;

  • That any Confidential Information shared by Program participants or any representative of the Company is confidential and proprietary, and belongs solely and exclusively to the Participant who discloses it or the Company;

  • Not to disclose such information to any other person or use it in any manner other than in discussion with other Program participants during Program sessions;

  • That all materials and information provided to you by the Company are its confidential and proprietary intellectual property, and may only be used by you as authorized by the Company;

  • The reproduction, distribution, and sale of these materials by anyone but the Company is strictly prohibited;

  • That if you violate, or display any likelihood of violating, any of your agreements contained in this paragraph, the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

While you are free to discuss your individual results from our programs and training, you must keep the experiences and statements, oral or written, of all other participants in the strictest of confidence.

Your participation is also subject to our Privacy Policy and Terms of Use.

3. PROGRAM CONTENT
​

  • Program education and information are intended for a general audience and do not purport to be, nor should they be construed as, advice or counseling tailored to any specific business or industry.

  • All materials, procedures, policies, and standards, all manuals, all teaching aids, and the like that have been or will be made available by Althea Wellness Company or its designated facilitators, or any other source, oral or written, are for individual use in or in conjunction with this training program only.

  • Program content is for individual use only and may not be sold, tape-recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of Althea Wellness Company or its designated agent.

  • The information contained in program material is strictly for educational purposes. Therefore, if you wish to apply (or not apply) ideas contained in this material, you are taking full responsibility for your actions.

  • We assume no responsibility for errors or omissions that may appear in any program materials.

 

5. OFFER AND PAYMENT TERMS
​

  • The program is a 3 month program that provides coaching, accountability, and private community access. Any events offered do not roll over if unattended.

  • The fee for this program has the following options: Pay In Full (save 10%), Buy Now Pay Later Options. The price is listed on the respective checkout page sent to you in the enrollment process.

  • You agree that no pauses or suspensions will be made once this agreement is signed. If you move, decide to stop your current business, determine that you would not like to be in the program anymore, or anything else, no pauses or cancellations will be made to payments. Pauses and suspensions are at the sole discretion of Althea Wellness Company.

6. AUTOMATIC RENEWAL (For Recurring Payments)
​

  • Your subscription will automatically renew every month unless canceled prior to the renewal date.

  • The renewal fee will be charged to your original payment method unless updated.

  • You may cancel your renewal at any time through account settings before the next billing cycle to avoid future charges.

  • If you do not cancel prior to the renewal date, your subscription will continue for another month term under the same terms and conditions.

7. THIRD-PARTY FINANCING PROVIDERS 
​

Althea Wellness Company may offer customers the option to utilize third-party financing providers, such as Affirm, Klarna, to facilitate payment for products or services. By choosing to finance a purchase through one of these providers, you acknowledge and agree to the following terms:

​

  • Independent Agreement: Any financing agreement entered into with a third-party financing provider is an independent agreement between you and the respective provider. Althea Wellness Company is not a party to any financing arrangement and does not influence or control the terms, approval process, or conditions set by these providers.

  • Payment Responsibility: You are solely responsible for complying with the payment terms established by the third-party financing provider. Althea Wellness Company is not responsible for any late fees, interest charges, penalties, or other obligations arising from your agreement with the financing provider.

  • No Liability: Althea Wellness Company is not liable for any disputes, claims, or issues that may arise between you and the financing provider, including but not limited to credit decisions, payment processing errors, or changes in financing terms. Any concerns or disputes regarding financing should be directed to the respective third-party provider.

  • Non-Refundable Transactions: Payments made through third-party financing providers remain subject to Althea Wellness Company’s refund and cancellation policies. Approval of financing does not alter the refund eligibility of your purchase as outlined in our Terms and Conditions.

8. DISCLAIMERS AND LIMITATION OF LIABILITY
​

  • Althea Wellness Company makes no guarantees regarding specific outcomes or success from participation in the program.

  • You acknowledge that your results depend on individual effort, unique biology, and other factors beyond our control.

  • We shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising from your participation in the program.

9. FORCE MAJEURE
​

  • Althea Wellness Company shall not be held responsible for delays or failure in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, government restrictions, pandemics, cyber-attacks, or labor disputes.

​

10. NO LEGAL OR FINANCIAL ADVICE
​

  • Any health advice, coaching, or health protocols provided within the program are for informational and educational purposes only.

  • You should seek professional advice from doctors, dieticians, or other certified professionals before making decisions.

​

11. MODIFICATIONS TO THE AGREEMENT
​

  • Althea Wellness Company  reserves the right to modify these terms at any time. Updated terms will be posted on our website, and continued participation constitutes acceptance.
